![]() Bankruptcy Counseling and Certification Bankruptcy is a choice that will have an effect on the rest of your life and is not a decision that should be taken lightly. With the enactment of the Bankruptcy Abuse Prevention and Consumer Protection Act it has also become even more complex. Among the provisions of the new law are mandatory counseling courses each consumer must fulfill: Counseling Requirement 1: An individual may not be
a debtor under this title unless such individual has, during the 180-day
period preceding the date of filing of the petition by such individual,
received from an approved nonprofit budget and credit counseling agency an
individual or group briefing (including a briefing conducted by telephone or
on the Internet) that outlined the opportunities for available credit
counseling and assisted such individual in performing a related budget
analysis. How Do I Begin? To complete Counseling Requirement #1 for Pre-Petition Bankruptcy Counseling we request a contribution to cover the costs involved with the pre-bankruptcy filing certification of $50.00. This contribution can be made through a bank draft submitted using our contribution form to continue. Click here to go to the Pre-Petition Bankruptcy Counseling contribution form. Any donation is not mandatory, and services will be provided regardless of the clients ability to pay such donations. We will require two forms of identification before beginning the counseling session, such as a drivers license and a bill such as a utility that has your current name and address on it. This identification must be submitted to our office either in person, by mail, email or fax before the pre-petition bankruptcy counseling can be completed. If married and both parties are filing, identification of both parties must be provided.
